Resumen. La congregación fundada por Vicente de Paúl y Luisa de Marillac ha estado ligada al cuidado y, por su formación y método de trabajo, pueden ser consideradas como pioneras de los cuidados de enfermería, ya que su objetivo ha sido y es cubrir las necesidades básicas de la persona, teoría que postularía en 1960 Virginia Henderson. En este trabajo se pretende dar a conocer cómo las Hijas de la Caridad han estado ligadas al cuidado de la salud desde sus (...) inicios y la labor socio sanitaria que durante casi 150 años lleva prestando en Zaragoza la Casa de Amparo. Desde su inauguración el 5 de marzo de 1871, y gracias al apoyo económico del Ayuntamiento de Zaragoza, esta Institución proporciona asilo y cuidados a toda persona mayor que carece de recursos necesarios. Desde el primer momento se encargaron de ello las Hijas de la Caridad que, sin apenas recursos ni conocimientos, cuidaron de los asilados. Con el paso del tiempo, estos cuidados han ido evolucionando y profesionalizándose hasta que, en la actualidad, están siendo procurados por personal sanitario especializado; a pesar de ello, las hermanas siguen presentes en la vida de la residencia prestando su ayuda aquellos que lo necesitan. The congregation founded by Vicente de Paul and Luisa de Marillac has been linked to care and, because of their training and working method, they can be considered as pioneers of nursing care, since their objective has been and is to cover the basic needs of the person, a theory that Virginia Henderson would postulate in 1960. This paper aims to make known how the daughters of charity have been linked to health care since its inception and the social and health work that the Casa de Amparo has been providing in Zaragoza for almost 150 years. Since its inauguration on March 5, 1871, and thanks to the economic support of the City Council of Zaragoza, this Institution provides asylum and care for all older people who lack the necessary resources. From the first moment the daughters of the charity took care of it, who, without scarce resources or knowledge, took care of the asylees. With the passage of time, these cares have been evolving and professionalizing until, at present, they are being procured by specialized health personnel; In spite of this, the sisters are still present in the life of the residence, helping those who need it. Platón fue quien añadió a este concepto una nueva definición que caracterizaba a un tipo concreto de arte y distinguió el arte que produce objetos del que simplemente los representa. Decía que el arte imita a la naturaleza, que era un espejo de la realidad, de la naturaleza. Inclusive desde su misma teoría de las ideas, el arte no era más que copia de la copia y, por (...) tanto, sombra de la realidad verdadera, y por esto mismo no lo consideraba importante, pues la misma imitación se caracterizaba en términos de duplicar algo de algo que existía, y si se tenían las cosas en frente, para qué querría alguien tener una imitación de eso. The data showed in this review exposes basic aspects that define organic foods and some factors that influence consumption by the population, ie, its production in the country and the motivations for the consumption of food produced in this system. This way of production, originated in the early decades in the 20th century, nowadays involves environmental, social and health aspects. Although the environment is a more evident aspect than other ones, economic output and potential beneficial to health are discussed further (...) in this description about organic foods. Brazil, has excelled in the growth of this type of farming, however holds the 6th position in the world and 2nd producer in Latin America, with grains and vegetables being the main products, although the livestock reaches the largest area. The consumption of these products is primarily motivated by the perception of organic food as healthier than other kinds of food. However, there are no conclusive studies about better nutritional value, where nutrient concentrations are often unchanged. In contrast the presence of more phytochemicals compounds and reduced pesticides’ content in vegetables, and lipid profile in animal products can justify the health benefits of the products obtained from the organic production system. Introduction Hospital delirium is a frequent, serious, costly, and underrecognized acute disorder of attention and cognition. Therefore, the prevention of hospital delirium is not only desirable for patients, caregivers, healthcare professionals, and the health system itself, but also a moral duty. Objective To identify and synthetize the main ethical aspects that arise related to the prevention of hospital delirium in patients 65 years and older. Methods A scoping review was carried out in Embase, Medline, and Web of Science. Articles published (...) in English or Spanish analyzing any pharmacologic, non-pharmacologic, or multicomponent intervention for prevention of delirium in hospitalized patients aged 65 years and over were included. Results Twenty-seven studies were included. Based on the frequency of appearance and the relevance, our findings were organized into three main areas. The first one was related to the principle of nonmaleficence and collected findings about the iatrogenic causes of hospital delirium and the use of restraints systems. The second area analyzed the impact of delirium in patients, families, and healthcare professionals from a relational ethics perspective, and addressed the family presence as a factor to prevent delirium. Finally, the third area is related to the quality of care. Conclusion Prevention of delirium in hospitals is essential to avoid the discomfort and potential clinical complications of patients, as well as the suffering of their relatives, caregivers, and healthcare professionals. Policymakers and healthcare managers are encouraged to make the required efforts to prevent delirium in hospitalized older patients. (shrink)

La gestión de la pandemia de COVID-19 por parte de los países occidentales es uno de los temas más controvertidos de los estudios sociales actuales. Uno de los conceptos centrales para analizar la ordenación de la gestión de la pandemia es el de Cosmopolítica, ya que nos permite ampliar la comprensión de la política para incluir a los ciudadanos, a los seres vivos no humanos, a los elementos terrestres y al propio SARS-CoV-2. Pero como argumentamos en este artículo, la cosmopolítica (...) necesita un poder previo, una potentia generativa que emana de la disposición de los actores mencionados. A partir del ejemplo de los meses en que se desarrolló y comenzó a inocularse la vacuna contra la COVID-19, ilustraremos la propuesta cosmoética: una ética afirmativa que tiñe y permea el agenciamiento de actores que constituyen la vacuna, permitiendo su despliegue para un posterior momento cosmopolítica. De este modo, concluimos que la gestión de la pandemia necesita no sólo atender a los ciudadanos no expertos o a los actores no humanos, sino también atender a la emergencia de nuevas realidades, tiempos y espacios. This predominance makes it difficult for healthcare professionals to deal with the ethical dilemmas that emerge in this subspecialty. This paper is a first endeavor to empirically investigate the axiological foundations of the healthcare professionals in a cardiology hospital. Our pilot study selected, as the target population, cardiology personnel not only because of their difficult ethical deliberations but also because of the stringent conditions in which they (...) have to make them. Therefore, there is an urgent need to reconsider clinical ethics and Value-Based Medicine. This study proposes a qualitative analysis of the values and the virtues of healthcare professionals in a cardiology hospital in order to establish how the former impact upon the medical and ethical decisions made by the latter.ResultsWe point out the need for strengthening the roles of healthcare personnel as educators and guidance counselors in order to meet the ends of medicine, as well as the need for an ethical discernment that is compatible with our results, namely, that the ethical values developed by healthcare professionals stem from their life history as well as their professional education.ConclusionWe establish the kind of actions, communication skills and empathy that are required to build a stronger patient-healthcare professional relationship, which at the same time improves prognosis, treatment efficiency and therapeutic adhesion. By mid-2019 there were more than 80 AI ethics guides available in the public domain. Despite this, 2020 saw numerous news stories break related to ethically questionable uses of AI. In part, this is because AI ethics theory remains highly abstract, and of limited practical applicability to those actually responsible for designing algorithms and AI systems. Our previous research sought to start closing this gap between the ‘what’ and the ‘how’ of AI ethics through the creation of a searchable typology (...) of tools and methods designed to translate between the five most common AI ethics principles and implementable design practices. Whilst a useful starting point, that research rested on the assumption that _all_ AI practitioners are aware of the ethical implications of AI, understand their importance, and are actively seeking to respond to them. In reality, it is unclear whether this is the case. It is this limitation that we seek to overcome here by conducting a mixed-methods qualitative analysis to answer the following four questions: what do AI practitioners understand about the need to translate ethical principles into practice? What motivates AI practitioners to embed ethical principles into design practices? What barriers do AI practitioners face when attempting to translate ethical principles into practice? And finally, what assistance do AI practitioners want and need when translating ethical principles into practice? (shrink)

It is commonly recognized that one can act rightly without being praiseworthy for doing so. Those who act rightly from ignoble motives, for instance, do not strike us as fitting targets of moral praise; their actions seem to lack moral worth. Though there is broad agreement that only certain kinds of motives confer moral worth on our actions, there is disagreement as to which ones are up to the task. Many theorists confine themselves to two possibilities: praiseworthy agents are thought (...) to be motivated by either the consideration that their actions are morally right, or the considerations that explain why their actions are morally right. Though there is an important element of truth in these proposals, each has limited explanatory purchase. In this paper, I develop a pluralist conception of moral worth that acknowledges both sorts of motives as grounds for moral praise. (shrink)

Note: this is the first published presentation and defense of the 'proper subset strategy' for making sense of non-reductive physicalism or the associated notion of realization; this is sometimes, inaccurately, called "Shoemaker's subset strategy"; if people could either call it the 'subset strategy' or better yet, add my name to the mix I would appreciate it. Horgan claims that physicalism requires "superdupervenience" -- supervenience plus robust ontological explanation of the supervenient in terms of the base properties. I argue that Horgan's (...) account fails to rule out physically unacceptable emergence. I rather suggest that this and other unacceptable possibilities may be ruled out by requiring that each individual causal power in the set associated with a given supervenient property be numerically identical with a causal power in the set associated with its base property. I go on to show that a wide variety of physicalist accounts, both reductive and non-reductive, are implicitly or explicitly designed to meet this condition, and so are more similar than they seem. In particular, non-reductive physicalism accounts typically appeal to a relation plausibly ensuring that the powers of a higher-level property are a proper subset of those of its physical base property. The physicalist thesis that all entities are nothing over and above physical entities is often interpreted as appealing to a supervenience-based account of "nothing over and aboveness”, where, schematically, the A-entities are nothing over and above the B-entities if the A-entities supervene on the B-entities. The main approaches to filling in this schema correspond to different ways of characterizing the modal strength, the supervenience base, or the supervenience connection at issue. I consider each approach in turn, and argue that the (...) resulting formulation of physicalism is compatible with physicalism’s best traditional rival: a naturalist emergentism. Others have argued that supervenience-based formulations of physicalism fail. My aim here, besides addressing the full spectrum of supervenience-based approaches, is to show how certain philosophical and scientific theses concerning naturalism, properties, and laws give us new reasons to think that supervenience-based formulations of physicalism are untenable. How should physical entities be characterized? Physicalists, who have most to do with the notion, usually characterize the physical by reference to two components: 1. The physical entities are the entities treated by fundamental physics with the proviso that 2. Physical entities are not fundamentally mental (that is, do not individually possess or bestow mentality) Here I explore the extent to which the appeals to fundamental physics and to the NFM (“no fundamental mentality”) constraint are appropriate for characterizing the physical, (...) especially for purposes of formulating physicalism. Ultimately, I motivate and defend a version of an account incorporating both components: The physics-based NFM account: An entity existing at a world w is physical iff (i) it is treated, approximately accurately, by current or future (in the limit of inquiry, ideal) versions of fundamental physics at w, and (ii) it is not fundamentally mental (that is, does not individually either possess or bestow mentality). El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

As the community corrections system has moved away from a focus on rehabilitation, it has been suggested that criminal offenders are no longer understood psychologically, but rather as rational actors for whom criminality is a choice. Rehabilitative efforts thus aim to guide these choices. Utilizing mixed methodology that draws on observational, interview, and case note data collected within the probation/parole system of a western U.S. state, I suggest that both officers’ conceptualizations of the criminal self and the rehabilitative strategies they (...) use are gendered. I find that officers view the male criminal self as flawed or underdeveloped and the female as permeable and amorphous, that is, lacking firm boundaries. In response to these constructions, officers aim to rehabilitate men largely by encouraging economic roles and responsibilities, while for women, rehabilitation aims to solidify boundaries: discouraging relationship formation and containing emotions. The differences identified point to ways in which gendered concepts of the criminal self contribute to gender disparities in contemporary supervision. (shrink)

I argue that it is permissible for pregnant women to expose their unborn children to risks and injury. I begin with the premise that abortion is permissible. If so, then just as a pregnant woman may permissibly prevent an unborn child from experiencing any future wellbeing, she also may permissibly provide her child relatively poorer prospects for wellbeing. Therefore, it is permissible for pregnant women to take risks and cause prenatal injury. This argument has revisionary implications for policies that prevent (...) medical research and drug use during pregnancy. It also explains why moralistic criticism of pregnant women is unwarranted. Contextualists such as Cohen and DeRose claim that the truth conditions of knowledge attributions vary contextually, in particular that the strength of epistemic position required for one to be truly ascribed knowledge depends on features of the attributor's context. Contextualists support their view by appeal to our intuitions about when it's correct (or incorrect) to ascribe knowledge. Someone might argue that some of these intuitions merely reflect when it is conversationally appropriate to ascribe knowledge, not when knowledge is truly ascribed, (...) and so try to accommodate these intuitions even on an invariantist view. DeRose (Blackwell Guide to Epistemology, 1998; Philosophical Review, 2002) argues that any such 'warranted assertibility manoeuvre', or 'WAM', against contextualism is unlikely to succeed. Here, I argue that his objections to a WAM against contextualism are not persuasive and offer a pragmatic account of the data about ascriptions of knowledge. (shrink)

I problematize Grounding-based formulations of physicalism. More specifically, I argue, first, that motivations for adopting a Grounding-based formulation of physicalism are unsound; second, that a Grounding-based formulation lacks illuminating content, and that attempts to imbue Grounding with content by taking it to be a strict partial order are unuseful and problematic ; third, that conceptions of Grounding as constitutively connected to metaphysical explanation conflate metaphysics and epistemology, are ultimately either circular or self-undermining, and controversially assume that physical dependence is incompatible (...) with explanatory gaps; fourth, that in order to appropriately distinguish physicalism from strong emergentism, a Grounding-based formulation must introduce one and likely two primitives in addition to Grounding; and fifth, that understanding physical dependence in terms of Grounding gives rise to ‘spandrel’ questions, including, e.g., “What Grounds Grounding?”, which arise only due to the overly abstract nature of Grounding. Horgan (1993) proposed that "superdupervenience" - supervenience preserving physicalistic acceptability - is a matter of robust explanation. I argued against him (1999) that (as nearly all physicalist and emergentist accounts reflect) superdupervenience is a matter of Condition on Causal Powers (CCP): every causal power bestowed by the supervenient property is identical with a causal power bestowed by its base property. Here I show that CCP is, as it stands, unsatisfactory,for on the usual understandings of causal power bestowal, it is trivially (...) satisfied or falsified. Drawing on recent work in formal pragmatic theory, this paper shows that the manipulation of discourse structure—in particular, by way of shifting the Question Under Discussion mid-discourse—can constitute an act of epistemic injustice. I argue that the “All Lives Matter” response to the “Black Lives Matter” slogan is one such case; this response shifts the Question Under Discussion governing the overarching discourse from Do Black lives matter? to Which lives matter? This manipulation of the discourse structure systematically obscures the intended (...) meaning of “Black lives matter” and disincentivizes future utterances of it. (shrink)

The construct of wellbeing has been criticised as a neoliberal construction of western individualism that ignores wider systemic issues such as inequality and anthropogenic climate change. Accordingly, there have been increasing calls for a broader conceptualisation of wellbeing. Here we impose an interpretative framework on previously published literature and theory, and present a theoretical framework that brings into focus the multifaceted determinants of wellbeing and their interactions across multiple domains and levels of scale. We define wellbeing as positive psychological experience, (...) promoted by connections to self, community and environment, supported by healthy vagal function, all of which are impacted by socio-contextual factors that lie beyond the control of the individual. By emphasising the factors within and beyond the control of the individual and highlighting how vagal function both affects and are impacted by key domains, the biopsychosocial underpinnings of wellbeing are explicitly linked to a broader context that is consistent with, yet complementary to, multi-levelled ecological systems theory. Reflecting on the reciprocal relationships between multiple domains, levels of scale and related social contextual factors known to impact on wellbeing, our GENIAL framework may provide a foundation for a transdisciplinary science of wellbeing that has the potential to promote the wellbeing of individuals while also playing a key role in tackling major societal challenges. We introduce the papers in this special issue by providing an overarching perspective on the variety in kinds of commons and the ethical issues stemming from their diversity. Despite a long history of local commons management, recent decades have witnessed a surge of scholarly interest in the concept of “the commons,” including a growing management literature. This swell was impelled especially by Garrett Hardin’s paper of 1968, and the body of work generated by Elinor Ostrom and her colleagues. However, the (...) term itself has come to be used in a variety of ways. To contextualize its ethical dimensions, we map a number of commons-related concepts such as common-pool resources, common property regime, excludability and subtractability, common-pool resource types and commons or “commoning” as a source of production. Following a brief summary of papers in this special issue, the essay concludes with an identification of implications for research, practice and policy. (shrink)

The main contribution of this paper is a new account of how a community may introduce a term for a natural kind in advance of knowing the correct scientific account of that kind. The account is motivated by the inadequacy of the currently dominant accounts of how a community may do this, namely those proposed by Kripke and by Putman. Their accounts fail to deal satisfactorily with the facts that (1) typically, an item that instantiates one natural kind instantiates several (...) - 'the higher-level natural kinds problem', and (2) natural kinds often occur in nature in impure form - 'the composition problem' .On the account I propose, a term for a natural kind gains its reference by being associated with a recognitional capacity for that kind. I show how members of a scientifically ignorant community could have a recognitional capacity for a natural kind, say gold, as opposed to a certain kind of appearance, for instance the appearance that gold actually has. I argue that members of such a community can have recognitional capacities for particular natural kinds despite the actual or possible existence of duplicate kinds, e.g. water. After developing the account in detail, I show how it can deal with the two problems faced by Kripke's and Putnam's problem. The case of natural kind terms is crucial to the central debate in the philosophy of language and the philosophy of mind about whether we can refer non-descriptively to objects and kinds in the world. We standardly attribute beliefs to both individuals and organised groups, such as governments, corporations and universities. Just as we might say that an individual believes something, for instance that oil prices are rising, so we might say that a government or corporation does. If groups are to genuinely have beliefs, then they need states with the characteristic features of beliefs. One feature standardly taken to characterise beliefs is their mind to world direction of fit: they should fit the way the (...) world is. By contrast, desires are standardly taken to have a world to mind direction of fit: they aim for the world to be a certain way and are satisfied when the world fits them. Recently, Lackey ( 2021 ) has appealed to direction of fit to argue against certain nonsummative accounts of group belief. Here, I argue that on deeper inspection, belief’s mind to world direction of fit is difficult to accommodate on summative accounts of group belief including Lackey’s own neo-summative account. Further, I argue that direction of fit considerations in fact motivate the main non-summative approaches to belief, namely functionalism and interpretationism. Along the way, we see how addressing the issue of the direction of fit of group beliefs raises important questions about how to understand group evidence and its relationship to the evidence of members. Kant distinguishes cognition and thought. Mere thoughts do not conform to the conditions that Kant places on cognition and hence do not represent objects of experience. They are, nevertheless, intelligible, and play a vital role in our mental and moral lives. I offer the beginnings of an account of mere thought using Kant's resources. I consider four key cases of intelligible representations that lack objective validity: unschematized categories; transcendental ideas; philosophical concepts; thoughts that violate principles of the understanding.

This paper considers the UN efforts to introduce a legally binding Treaty on corporate accountability for human rights impacts in the context of other proposed legislation at country level, on the one hand, and existing voluntary initiatives like the UN Guiding Principles (2011), on the other. What we are interested in is whether the proposed Treaty signals a transition from voluntary initiatives (based on moral commitments) to law (that is, a focus on compliance), and the extent to which it might (...) stimulate or hinder links between judicial and non-judicial initiatives. The scholars who have explicitly addressed these two divides are – Michael Sandel, on theory v. practice; and Amartya Sen, on law v. morality. We engage with their views, in sections II and III respectively, seeking to build an integrated approach to help us overcome these dualisms. We further consider John Ruggie’s “principled pragmatism”, a strategy that he uses to build the Protect, Respect and Remedy (henceforth, PRR) Framework; and we invoke arguments from casuistry as well as a practice-focused deontology (Thomas Donaldson’s) in favour of an ethics ‘beyond cognition’, which we consider better suited than either utilitarian or principle-based theories to guide the debate on human rights. This is because it allows us to take non-rational factors into account (such as emotions and personal affiliations), when judging the kind of common good we consider worth pursuing. In the last section of the paper, we investigate whether and how might the Treaty illustrate the two divides, trying to (a) distinguish between purely legal elements and those of a wider nature, to do with morality; and (b) understand what might help bridge the gap between theoretical commitments to the universality of human rights and various practical challenges. Our aim is not to evaluate the Treaty, from a legal viewpoint, or suggest improvements to it (lawyers are better placed to do that); rather, we seek to investigate the way in which the proposed Treaty – which is the first attempt to address the challenge of transnational business and human rights in international law – combines moral and legal aspects, and what this tells us about the world we live in. This paper defends the following principle: For any visually perceptible set of objects and any visual phenomenal character, there could be a veridical perception of exactly those objects with that character. This principle is rejected by almost all contemporary theories of perception, yet rarely addressed directly. Many have taken the apparent inconceivability of a certain sort of “shape inversion” — as compared to the more plausible, frequently discussed “color inversion” — as evidence that the spatial characters of our perceptions are (...) uniquely suited to and/or revelatory of the structure of their objects, such that alleged perceptions of those objects that differed radically in spatial character could not be veridical. I argue that these conclusions are unjustified: I claim that the difficulty involved in constructing coherent “shape inversion” scenarios is attributable to the complex relations among visual and tactile shape experiences, as opposed to relations between shape experiences and worldly shape properties.
